Overview

This website is operated by Hellion Machine Collective, LLC, a Pennsylvania limited liability company located in Erie, Pennsylvania, doing business as HMC Knives. Throughout the site, "we," "us," and "our" refer to HMC Knives. We offer this website, including all information, tools, and services on it, to you, the user, on the condition that you accept all the terms, conditions, policies, and notices stated here.

By visiting our site and/or buying something from us, you use our "Service" and agree to be bound by these Terms of Service ("Terms"), including the additional policies referenced here and linked from this page: our Privacy Policy, Refund Policy, Shipping Policy, and Warranty. These Terms apply to all users of the site, including browsers, customers, and contributors of content.

Please read these Terms carefully. If you do not agree to all of them, you may not use the website or any services.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that lets us sell our products and services to you. Payments are processed by third-party payment processors.

Section 1: Eligibility and age requirement

You must be at least 18 years old (or the age of majority in your state, if higher) to buy any knife or bladed product from us. By placing an order, you represent that you meet this requirement. We may ask for proof of age, and we may cancel and refund any order if we believe the buyer is underage. You may not use our products for any illegal or unauthorized purpose. In using the Service, you may not violate any laws in your jurisdiction. You must not transmit worms, viruses, or any destructive code. Breaking any of these Terms will result in immediate termination of your Services.

Section 2: Knife laws and buyer responsibility

Knife laws differ by country, state, county, and city, and may restrict blade length, opening mechanism, carry method, or ownership. You alone are responsible for knowing and following all laws that apply to buying, receiving, owning, carrying, and using any product you buy from us. By ordering, you confirm that the product is legal for you to buy and receive at your shipping address. We make no representation that any product is legal in your jurisdiction and are not liable for your possession or use of any product in violation of the law. We may refuse or cancel an order to any destination at our discretion. Knives and all other non-apparel products ship to the United States only. Apparel ships worldwide (see our Shipping Policy).

Knives are sharp tools. Use, carry, maintain, and store them safely and keep them away from children. HMC Knives is not responsible for injury or damage caused by misuse, negligence, or unsafe handling.

Section 3: General conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted, which involves (a) transmission over various networks and (b) changes to conform to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any part of the Service without our express written permission. The headings in these Terms are for convenience only and do not limit or affect the Terms.

Section 4: Accuracy, completeness, and timeliness of information

We are not responsible if information on this site is inaccurate, incomplete, or out of date. The material on this site is for general information only. Any reliance on it is at your own risk. We may change the site's contents at any time but have no obligation to update any information.

Section 5: Modifications to the Service and prices

Prices are subject to change without notice. We may modify or discontinue the Service (or any part or content of it) at any time without notice. We are not liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

Section 6: Products, limited drops, and pre-orders

Limited drops. Our knives are made in small batches and released in limited "drops," usually announced to our email list first. Quantities are limited, and products are sold on a first-come, first-served basis. Adding an item to your cart does not reserve it; an item is yours only after checkout is completed and payment is authorized. We may limit quantities per customer, household, payment method, or address, and may cancel orders that exceed limits or appear to be placed by dealers, resellers, distributors, or automated tools (bots).

Pre-orders and made-to-order items. Some products are sold as pre-orders or made to order. Unless the product page says otherwise: (a) payment is due up front, in full, at checkout (refunds are available until the order ships, as described in our Refund Policy); (b) pre-order quantities are capped; (c) the completion or ship date shown is an estimate, not a guarantee (for example, "estimated time of completion: 8 weeks"), and handmade production can be delayed by materials, tooling, or other factors; (d) no modifications or changes are offered during a pre-order; and (e) cancellation and refund terms for pre-orders are as stated on the product page and in our Refund Policy. We'll notify you by email if a pre-order is significantly delayed.

Custom and personalized items. We are not currently accepting custom orders. If we offer custom, personalized, or modified items in the future, those items are made to your specifications and are final sale. They cannot be returned, exchanged, or refunded except as required by law.

Knife Spa services. Knife Spa services are performed on knives you send to us. We'll restore your knife as close to its original condition as its current state allows. Spa services are non-refundable. You're responsible for packaging your knife securely and for its safe delivery to us; we recommend a trackable shipping method.

Aftermarket parts. Accents, clips, backspacers, pivot collars, and other parts are size- and version-specific (for example, 2.9" parts don't fit 3.2" knives). Please confirm compatibility before you buy. HMC Knives is not responsible for damage to your knife during installation of any part; installation is at your own risk. Natural and Damascus-type materials (such as DarkTi) are non-uniform, and colors and patterns may not match exactly.

Product appearance. Each knife is machined and finished by hand, and minor variations in finish, color, anodization, and texture are normal and are not defects. We make every effort to display product colors and images accurately but can't guarantee your screen shows them accurately.

We may discontinue any product at any time. Any offer made on this site is void where prohibited.

Section 7: Returns, refunds, and warranty

Orders can be cancelled and refunded until they ship. Once shipped, all knife sales are final, except as described in our Refund Policy. You have 48 hours from delivery to report manufacturing defects. Warranty claims are handled under our Warranty page.

Section 8: Accuracy of billing and account information

We may refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities bought per person, per household, or per order. If we change or cancel an order, we'll try to notify you by the email and/or billing address or phone number you gave us. You agree to provide current, complete, and accurate purchase and account information and to update it promptly as needed.

Section 9: Payments and taxes

You agree to pay all charges for your order, including any shipping charges shown at checkout. Prices are in U.S. dollars and any applicable taxes are already included in our prices; we do not add sales tax at checkout. For apparel shipped outside the United States, customs duties or import taxes charged by the destination country are the recipient's responsibility. Payment is processed by our third-party payment processor(s) under their terms. We do not store full card numbers.

Section 10: Email marketing

If you opt in to our email list, you agree to receive drop announcements, newsletters, educational content, and promotional emails. You may unsubscribe at any time with the link in any email. Getting a drop announcement does not guarantee availability. Giveaways are subject to their own official rules, posted with each giveaway.

Section 11: Optional tools and third-party links

We may give you access to third-party tools we don't monitor or control. They are provided "as is" and "as available," without warranties, and your use of them is at your own risk. Third-party links on this site may lead to websites not affiliated with us. We are not responsible for their content, products, or practices.

Section 12: User comments, reviews, and other submissions

If you send us reviews, photos, comments, suggestions, contest entries, or other materials ("comments"), you agree that we may edit, copy, publish, distribute, translate, and otherwise use them in any medium without restriction or compensation. We have no obligation to keep comments confidential, pay for them, or respond to them. We may remove content we find unlawful, offensive, threatening, defamatory, obscene, or otherwise objectionable, or that infringes anyone's rights. You are solely responsible for your comments and their accuracy and may not use a false email address or impersonate anyone.

Section 13: Personal information

Your submission of personal information through the store is governed by our Privacy Policy.

Section 14: Errors, inaccuracies, and omissions

The site may sometimes contain typographical errors, inaccuracies, or omissions in product descriptions, pricing, promotions, shipping charges, transit times, and availability. We may correct them and change or cancel orders if any information is inaccurate, at any time and without prior notice, including after you've submitted an order. If we cancel a paid order, we'll refund your payment.

Section 15: Intellectual property

All content on this site, including the HMC Knives and Hellion Machine Collective names and logos, product designs, text, photos, and videos, belongs to HMC Knives or its licensors and is protected by intellectual property laws. You may not use it without our written permission.

Section 16: Prohibited uses

You may not use the site or its content: (a) for any unlawful purpose; (b) to solicit others to commit unlawful acts; (c) to violate any international, federal, state, or local law; (d) to infringe our intellectual property or anyone else's; (e) to harass, abuse, insult, harm, defame, or discriminate; (f) to submit false or misleading information; (g) to upload viruses or malicious code; (h) to collect or track others' personal information; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape, or to use bots or automated means to buy products; (j) for any obscene or immoral purpose; or (k) to interfere with or get around the site's security features. We may terminate your use of the Service for any prohibited use.

Section 17: Disclaimer of warranties; limitation of liability

Except for the express warranty on our Warranty page, the Service and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement, to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

In no case shall HMC Knives or its owners, officers, employees, affiliates, agents, contractors, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Service or any product, including misuse of a knife. To the extent the law allows, our total liability for any claim will not exceed the amount you paid for the product at issue. Some states don't allow these exclusions or limitations, so in those states our liability is limited to the maximum extent the law permits.

Section 18: Indemnification

You agree to indemnify, defend, and hold harmless HMC Knives and its owners, affiliates, partners, officers, agents, contractors, licensors, service providers, suppliers, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party because of your breach of these Terms or the documents they incorporate by reference, your violation of any law (including knife laws), or your violation of anyone else's rights.

Section 19: Severability

If any provision of these Terms is found unlawful, void, or unenforceable, it will still be enforced to the fullest extent the law allows, and the unenforceable portion will be severed without affecting the validity of the rest of the Terms.

Section 20: Termination

Obligations and liabilities incurred before termination survive it. These Terms remain in effect until either you or we terminate them. You may terminate them at any time by stopping use of the site. If we believe you have failed to comply with any provision, we may terminate this agreement without notice and deny you access to the Service.

Section 21: Entire agreement

Our failure to enforce any right or provision of these Terms is not a waiver of it. These Terms and any policies we post on this site are the entire agreement between you and us and supersede any prior agreements, communications, and proposals, including prior versions of these Terms. Any ambiguity in these Terms will not be construed against the drafting party.

Section 22: Governing law and venue

These Terms are governed by the laws of the United States and the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Erie County, Pennsylvania.

You can review the most current version of these Terms at any time on this page. We may update, change, or replace any part of them by posting updates on our website. Your continued use of the site after changes are posted means you accept them.
